Gay Marriage Likely Heading to the Supreme Court

We may soon be thanking the state of Utah. They intend to appeal the Court of Appeals ruling about their same-sex marriage ban.

Legal experts don't expect a quick response from the SC. But if their decision on DOMA is any indication, same-sex marriage bans may soon be doomed for all of the remaining states.

Since there have been no lower federal courts that have upheld other state bans in the recent wave, chances are pretty good that the supreme court won't even take up the case. That will leave the lower court decisions in place, but only in those districts where the decisions have been made. Unfortunately, that means it won't be decided on a full, national level.

Eventually they wont have a choice, there will be too many cases piling up for review. Utah is just the one that will be first, the other 15 states homophobes are still pushing.

A judge just ruled that the marriage ban in CO to be unconstitutional as well.

2/3 of the cases the SCOTUS hears involves appeals from lower federal courts and usually address constitutional issues or federal law. So my layman's opinion is that they'll hear the case sooner rather than later.

Though they aren't obligated to take up any of the cases, they plan on discussing it after their summer break. That in itself is a very good sign that they will hear arguments and make a ruling. That sooner rather than later turned out to be just over 2 months. :P

By rejecting appeals in cases involving Virginia, Oklahoma, Utah, Wisconsin and Indiana, the court left intact lower-court rulings that had struck down the bans in those states. But the high court's action means there will be no imminent national ruling on the issue, with litigation in states where gay marriage is still banned likely to continue...The court could still take a future case, but its move on Monday is likely to send a strong signal to lower court judges that rulings striking down marriage bans are consistent with the U.S. Constitution.

In declining to hear the appeals from various states, the SCOTUS is letting the rulings stand that say that same-sex marriage bans are unconstitutional (or otherwise struck down for other reasons). It's not the outcome that we were hoping for but it is a victory none-the-less. Small steps in the right direction still lead us to where we need to be.

I'm almost disappointed that it wasn't the Utah case that got to the court. That would stick in the craw of the predominant theocracy here if it was because of their blatant homophobia that marriage was legal across the country. One law prof I heard said that surely the court thought of the fact back last year when they had the first chance that there were all these marriages that would be ripped asunder belligerently if they do find for the states.

It's pretty obvoius that there's only one way they can rule on this stuff unless they want to make Swiss cheese out of marriage law in the US, but none the less, I'm feeling pretty anxious to find out the ruling.
